In order to file a wrongful death claim, you must prove that your loved one died as a result of another person's negligence or wrongful actions.

In Texas, the surviving spouse may file a wrongful death suit within two years of the accident. Their children may also do so. If a family member has not filed a claim within three months, the executor may do so instead. Family members can obtain compensation for damages such as:
